Terms & Conditions

These are the terms and conditions on which we do business for goods ordered through our website. They do not affect your statutory rights and are designed to set out our responsibilities and your rights.

Terms and Conditions of Sale, Returns & Cancellations information
[1] These are the only terms and conditions upon which we agree to contract with you and no alteration of these terms and conditions shall be valid unless previously agreed in writing.


[2] A contract is formed between us when (and not before) we ship your order. Your order will not be accepted until we receive payment from your credit card or your cheque has been cleared.


[3] Before any contract is formed, any typographical, clerical or other error or omission in any literature, website based information, quotation, price list, acceptance of offer, invoice or other document or information issued by us shall be subject to correction without any liability on our part.


[4] All images are for illustration only. No images or illustrations contained in this website, catalogues or other advertising matter shall be deemed to form part of the contract but are for general information and guidance only.


[5] The total price of the ordered goods shall be as set out in the on-line order form and includes postage, packing and value added tax (if applicable). Payments may be made in pounds Sterling only.


[6] The ordered goods will be delivered to the address entered by you on the on-line order form. Ordered goods will normally be delivered within 1 to 5 working days of your order being accepted depending on your chosen delivery method, unless otherwise notified to you by us. However, time for delivery shall not be of the essence and we shall not be liable for any delay in delivery. If we fail to despatch any ordered goods within 30 days of accepting your order (or, in the case of special orders, any longer period which we may have notified to you), we shall refund in full your payment in respect of such goods. Ordered goods may also be made available for collection at our premises if we agree this with you.


[7] If you fail to take delivery of the ordered goods and they are returned to us, we will contact you in confirmation. We will refund the cost of goods without shipping or if the goods are still required, will ask for an additional shipping fee to make a second delivery.


[8] If any ordered goods are not readily available to us, we reserve the right to withdraw our acceptance of your order for such goods and to refund in full any payment you have made for them. For the avoidance of doubt other goods ordered by you will be despatched in the normal way.


[9] We warrant that, at the time of delivery, the ordered goods will, subject as hereinafter provided, correspond with the description on this website, will be free from defects in materials and workmanship and will be of satisfactory quality (within the meaning of the Sale and Supply of Goods Act 1994). There may, however, be minor variations between the goods as shown or described on our website and those despatched to you (but so that the goods despatched will always be of a comparable or superior quality).


[10] Unless otherwise notified to you by us, our returns policy is as follows.
All unworn and unwashed merchandise purchased from Fancy Dress Rocks website may be returned for a refund within 7 days from receipt of merchandise. Our costumes are sold in re-sealable packaging, which allows you to check suitability; as such we request these items to be returned in their original condition, together with any original packaging.

We will not refund: Items that have been worn, washed or soiled. Additionally for hygienic reasons unsealed items including; makeup, eyelashes, tights, wigs, underwear and masks. Some costumes have sealed wigs, in such cases if the costume is not appropriate please do not open the wig, as once it has been opened refunds cannot be given.


Instructions for returning merchandise: Before sending parcels back to us please phone us for a Returns Authorization Number which you can get by contacting the Fancy Dress Rocks customer service: Monday - Friday 9.00 am - 5.00 pm GMT on: 01792 895550 or e-mail us info@fancydressrocks.co.uk and we will contact you to make arrangements for the return. You will need to confirm your name, order number, and postcode so please have these available if you phone. When returning the merchandise please include the Returns Authorization Number as failure to do so will result in a delay of any refund.
Liability: We shall be under no liability in respect to any defect arising from; fair wear and tear, negligence or abnormal working conditions.


Disputed Items: Any returned merchandise that we receive which is outside of this Returns Policy will be defined as 'Disputed'. Such dispute items will not be refunded or exchanged and a reason for this decision will be provided. We are happy to re-ship such dispute items back to you at a cost to yourself; otherwise they will be destroyed within 91 calendar days from their receipt back to us.


Late Delivery: If the merchandise arrives too late for your event, refuse delivery for the merchandise and it will be returned to us. Alternatively you can return them as outlined above. If Fancy Dress Rocks or our couriers are at fault we will refund all cost of merchandise and P&P. A reason why we may not be at fault is that you have selected to use an incorrect postage option, or you were absent during delivery, in such a case the cost of returning to sender will be charged at the cost of postage paid, plus an additionl £2 charge for picking and packing cost. This amount will be deducted from any refunds.

[11] We shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow our instruction (whether oral or in writing), misuse or alteration or repair of the ordered goods without our approval.


[12] Except in the case of death or personal injury caused by our negligence, we shall not be liable to you by reason of any representation or any implied warranty, condition or other term, or any duty at common law or under these terms and conditions, for any special, indirect or consequential damage.


[13] Subject as expressly provided in these terms and conditions, and except where the ordered goods are sold to you contracting as a consumer (within the meaning of the Unfair Contract Terms Act 1977), all warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law.

[14] Order Cancellations

If the product has not been shipped, simply telephone us in the first instance and then send a confirmation email. We will cancel the order (or part thereof) with no charge to you with all moneys being refunded in full. If however the goods have left the warehouse, then you may still cancel the order up to 7 calendar days from receipt of goods. So long as they are returned (at your own cost) and we are informed within 7 days, we will happily refund the cost of the goods, excluding shipping. [15] Not all costumes are held instore. To avoid dissapointment please phone us to confirm that we have what you're looking for.
